Terms & Conditions

1. Introduction

These Terms and Conditions govern the provision of painting and plastering services by AFSM Painting & Plastering ABN [ABN Number] ("AFSM Painting", "we", "us") to clients ("you", "the client"). By accepting a quote or engaging our services, you agree to these terms in full.

2. Quotes & Estimates

  • All quotes are provided free of charge and are valid for 30 days from the date of issue.
  • Quotes are based on a site inspection or information provided by the client. Any changes to the scope of work after acceptance may result in revised pricing.
  • Written acceptance of a quote constitutes a binding agreement between AFSM Painting and the client.
  • Verbal agreements are not binding and must be confirmed in writing.

3. Scheduling & Access

  • A start date will be agreed upon at the time of booking, subject to weather conditions and crew availability.
  • The client must ensure that AFSM Painting has safe and unobstructed access to all areas to be painted on agreed work days.
  • Any delays caused by the client's failure to provide access may result in rescheduling fees.
  • AFSM Painting reserves the right to reschedule work in the event of unsafe weather conditions.

4. Payment Terms

  • A deposit of 20–30% of the total quote value may be required prior to commencement of work.
  • The balance is due upon completion of the job, unless otherwise agreed in writing.
  • Payment is accepted by bank transfer (EFT), cash, or other agreed methods.
  • Overdue invoices may attract interest at a rate of 2% per month and may be referred to a debt collection agency.
  • AFSM Painting reserves the right to suspend or cease work if payments are not made in accordance with agreed terms.

5. Materials & Products

  • AFSM Painting uses premium Australian paint brands including Dulux and Haymes unless otherwise specified by the client.
  • The client may request specific paint brands or colours, which may affect pricing.
  • All materials supplied by AFSM Painting remain our property until full payment is received.

6. Workmanship Warranty

  • AFSM Painting provides a 2-year workmanship warranty on all interior and exterior painting services.
  • This warranty covers defects in our workmanship (e.g. peeling, flaking) under normal conditions.
  • The warranty does not cover damage caused by the client, third parties, extreme weather events, or normal wear and tear.
  • The manufacturer's warranty applies separately to all paint products used.
  • Warranty claims must be submitted in writing within the warranty period.

7. Liability

  • AFSM Painting holds comprehensive public liability insurance.
  • Our liability is limited to the value of the services provided. We are not liable for indirect losses, loss of income, or consequential damages.
  • The client is responsible for removing or protecting valuable items and furnishings before work commences. AFSM Painting will take reasonable care but is not liable for pre-existing damage.

8. Cancellation

  • Cancellations must be made at least 48 hours before the scheduled start date.
  • Cancellations with less than 48 hours' notice may incur a cancellation fee of up to 15% of the quoted value.
  • Any deposit paid may be forfeited in the event of late cancellation.

9. Australian Consumer Law

Nothing in these Terms & Conditions excludes, restricts, or modifies any rights or remedies you may have under the Competition and Consumer Act 2010 (Cth) and associated Australian Consumer Law, including consumer guarantees. Where such statutory rights cannot be excluded, AFSM Painting's liability is limited to re-supplying the services or paying the cost of having the services supplied again.

10. Disputes

In the event of a dispute, both parties agree to attempt to resolve the matter in good faith within 14 days of written notice. If a resolution cannot be reached, either party may refer the matter to the Victorian Civil and Administrative Tribunal (VCAT) or another appropriate dispute resolution body.

11. Governing Law

These Terms & Conditions are governed by the laws of the State of Victoria, Australia. Both parties submit to the non-exclusive jurisdiction of the courts of Victoria.
